Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Pro Roto Inc ("Company," "we," "us," or "our") regarding your use of our website proroto.com and plumbing services.
By accessing our website or engaging our services, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these terms, please do not use our website or services.
Important: These Terms include provisions that limit our liability and require arbitration of disputes. Please read them carefully.
Services Provided
Pro Roto Inc is a licensed plumbing contractor (California License #947961, C-36 Classification) providing professional plumbing services throughout the Bay Area, including but not limited to:
Emergency Services
- 24/7 emergency plumbing repairs
- Burst pipe repairs
- Emergency drain cleaning
- Water heater emergencies
Installation Services
- Sewer line replacement
- Water line installation
- Water heater installation
- Fixture installation
Repair Services
- Pipe repair and repiping
- Leak detection and repair
- Toilet and faucet repairs
- Garbage disposal repair
Maintenance Services
- Plumbing inspections
- Drain cleaning
- Preventive maintenance
- Camera inspections
All services are subject to availability, proper licensing, and compliance with local building codes and regulations.
Service Agreements and Estimates
Quotes and Estimates
- All quotes and estimates are provided free of charge
- Estimates are valid for 30 days from the date of issuance
- Final costs may vary based on actual conditions discovered during service
- Any significant changes to estimated costs will be communicated before proceeding
- Emergency services may require immediate authorization without prior estimates
Service Authorization
By scheduling a service appointment, you authorize Pro Roto Inc to:
- Access the property at the scheduled time
- Perform necessary diagnostic work
- Execute approved repairs or installations
- Obtain required permits on your behalf
- Coordinate with utility companies as needed
Changes to Scope of Work
If additional work is discovered during service, we will notify you before proceeding. You have the right to approve or decline additional work. For emergency repairs, we may need to perform immediate work to prevent property damage, with notification as soon as practical.
Payment Terms
Accepted Payment Methods
We accept the following payment methods:
- Cash
- Checks (with valid ID)
- Credit cards (Visa, MasterCard, American Express, Discover)
- Debit cards
- ACH/Bank transfers for commercial accounts
Payment Terms and Conditions
- Residential Services: Payment is due upon completion of service unless other arrangements are made in advance
- Commercial Accounts: Net 30 payment terms available for established commercial accounts with approved credit
- Large Projects: May require deposit before work begins and progress payments during the project
- Emergency Services: Payment typically due at completion unless alternative arrangements are made
Late Payment
For accounts with credit terms:
- Invoices not paid within terms are subject to a late fee of 1.5% per month (18% annual percentage rate)
- Collection costs, including attorney fees, will be added to delinquent accounts
- Unpaid accounts may be reported to credit bureaus
Disputed Charges
If you believe there is an error in billing, you must notify us in writing within 30 days of the invoice date. We will investigate and respond within 15 business days.
Warranties and Guarantees
Workmanship Warranty
Pro Roto Inc guarantees all workmanship for one (1) year from the date of service completion.
If a problem arises due to our workmanship within the warranty period, we will return to repair it at no additional charge for labor.
Parts and Materials Warranty
- Parts and materials are covered by the manufacturer's warranty
- We will assist with warranty claims for defective parts
- Manufacturer warranties vary by product (typically 1-10 years)
- Water heaters typically carry 6-year manufacturer warranties
Warranty Exclusions
Warranties do not cover:
- Damage caused by misuse, abuse, or negligence
- Normal wear and tear
- Damage from freezing, earthquakes, or other natural disasters
- Work performed by unauthorized third parties
- Failure to follow recommended maintenance
- Pre-existing conditions not addressed in the original service
- Changes in building codes after installation
Warranty Claims
To make a warranty claim, contact us at (650) 269-0190. We will schedule a service call to assess the issue. You must provide proof of original service (invoice or receipt).
Cancellations and Refunds
Appointment Cancellations
- 24-Hour Notice: Cancellations made at least 24 hours before scheduled appointment incur no charge
- Late Cancellation: Cancellations made less than 24 hours before appointment may incur a cancellation fee
- No-Show: Failure to be present for a scheduled appointment may result in a service call charge
- Emergency Services: Different cancellation policies may apply
Refund Policy
We strive for complete customer satisfaction. If you are not satisfied with our services:
- Contact us within 7 days of service completion
- Describe the issue in detail
- Allow us the opportunity to correct the problem
- Refunds are issued at our discretion after investigation
Diagnostic fees, permit costs, and materials that have been installed are generally non-refundable unless there was a clear error on our part.
Customer Responsibilities
Property Access
You agree to:
- Provide clear access to work areas
- Remove obstacles and personal items from work areas
- Secure pets during service visits
- Ensure adequate lighting and utilities are available
- Be present or provide authorized access during scheduled appointments
- Provide accurate information about the property and plumbing system
Property Conditions
You represent that:
- You are the owner or authorized representative of the property
- You have the authority to approve work and modifications
- You will disclose known hazards (asbestos, lead, etc.)
- You will obtain any required HOA or landlord approvals
Maintenance
After service, you are responsible for:
- Following all maintenance recommendations
- Promptly addressing any issues that arise
- Not modifying or tampering with completed work
- Scheduling recommended follow-up services
Liability and Insurance
Our Insurance Coverage
Pro Roto Inc maintains over $4 million in comprehensive insurance coverage, including:
- General Liability Insurance ($1,000,000 per occurrence, $2,000,000 aggregate)
- Commercial Auto Liability ($1,000,000)
- Workers' Compensation ($1,000,000)
- Excess/Umbrella Liability ($2,000,000)
Limitation of Liability
To the fullest extent permitted by law:
- Our liability is limited to the amount paid for the specific service in question
- We are not liable for indirect, incidental, or consequential damages
- We are not responsible for damage to personal property left in work areas
- We are not liable for pre-existing conditions not addressed in our scope of work
- Claims must be made within one year of service completion
Property Damage
If our work causes property damage, we will repair or compensate for the damage according to our insurance policy terms. You must report any damage within 48 hours of service completion. We recommend photographing valuable items near work areas before service begins.
Emergency Services
Emergency plumbing services are available 24/7 for urgent situations such as:
- Burst pipes or major leaks
- Sewer backups
- Water heater failures
- Gas line emergencies
- Complete loss of water or drainage
Emergency Service Terms
- Emergency rates apply to after-hours, weekend, and holiday services
- Response times are estimated and not guaranteed
- Emergency authorization may be given verbally but must be confirmed in writing
- We may take necessary actions to prevent property damage without prior approval
- Payment is typically required immediately upon service completion
Permits and Code Compliance
Permits
For work requiring permits:
- We will obtain necessary permits on your behalf
- Permit fees are your responsibility and billed separately
- Work will not begin until permits are approved
- All work is subject to municipal inspections
- We will coordinate required inspections
Code Compliance
All work is performed in compliance with:
- California Plumbing Code
- Uniform Plumbing Code (UPC)
- Local building codes and ordinances
- Environmental regulations
If existing conditions do not meet current codes, we will recommend necessary upgrades. Code compliance upgrades may be required by the jurisdiction and will be discussed before proceeding.
Dispute Resolution
Informal Resolution
If you have a dispute with us, please contact us first to attempt informal resolution. Most issues can be resolved through direct communication with our management team.
Mediation
If informal resolution fails, both parties agree to attempt mediation before pursuing other remedies. Mediation costs will be shared equally.
Arbitration
For disputes exceeding $10,000, both parties agree to binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration will be conducted in San Mateo County, California.
Important: By agreeing to these Terms, you waive your right to a jury trial for covered disputes.
Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any legal action must be brought in the courts of San Mateo County, California.

Entire Agreement
These Terms, together with our Privacy Policy and any written service agreements, constitute the entire agreement between you and Pro Roto Inc.
Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our services after changes constitutes acceptance of the modified Terms.
Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.
Assignment
You may not assign or transfer your rights under these Terms. We may assign our rights and obligations to a successor business entity.
